RULEBOOK FOR REGISTRATION OF .BA DOMAIN

The rules for getting sub-domain under Bosnia and Herzegovina Internet Domain .BA

I - INTRODUCTORY NOTES

The rules for getting the sub-domain under Bosnia and Herzegovina (.BA) Internet Domain (country code Top Level Domain-ccTLD) are regulated with this document.

I - THE RULES FOR DOMAIN REGISTRATION

According to the international recommendations, .BA domain is divided to standard sub-domains:

a) The institution dealing with education, like primary, secondary, vocational schools, registered by the Ministry of Education, as well as private schools and firms, whose primary activity is education or training of any kind, can be registered under edu.ba domain (for instance, Secondary Medical School of Sarajevo has SMS.EDU.BA domain);

b) The civil organisations and associations, cultural institutions (museums, theatres) and other unprofitable legal entities can be registered under org.ba domain (for instance, Linux Association has LINUX.ORG.BA domain);

c) The institutions that are legal Internet services providers can be registered under net.ba domain (for instance, UTIC has UTIC.NET.BA domain);

d) The government institutions and ministries can be registered under gov.ba domain (for instance, The Ministry of Foreign Trade and Economy of B&H has MVTEO.GOV.BA domain);

e) All faculties, academies and other members of University of Sarajevo are registered under unsa.ba domain (for instance, Electro-technical Faculty of Sarajevo has ETF.UNSA.BA domain);

f) All faculties, academies and other members of the University of Bihac are registered under unbi.ba domain.


Beside the above mentioned, UTIC registers the sub-domains under .BA domain according to the principle of sub.domain.ba


III - THE NAMES OF SUB-DOMAINS UNDER .BA DOMAIN

The name of domain consists of a sequence of characters that must fulfil the following technical conditions:


a) It consists only of characters contained in the set of 26 English alphabet letters (regardless if they are capital or lower-case letters), “0”-“9” digits and “-“ character;

b) It consists of minimum 3 and maximum 63 characters;

c) The first and the last cannot be “-“, neither “-“ character can be twice in a row.


IV - THE BASIC CONDITIONS FOR GETTING OF DOMAIN

The request for the registration of an Internet domain under .BA can be submitted by:

1-Physical entity, a citizen of Bosnia and Herzegovina or a foreigner with approved permission for temporary stay;

2-
a) Legal entity, with a main office in B&H, which is registered in the Tax Administration of Cantonal Office (the canton where the legal entity registers the domain);

b) Legal entity branches;

c) Diplomatic and consular representative offices of foreign states in B&H;

d) International organisations;

e) Foreign firms (and other legal entities) that are authorised by a registered subject in B&H or by a lawyer’s office.

V - THE DOMAIN REGISTRATION FOR PHYSICAL ENTITIES

The registration procedure for domain under .ba domain

- Physical entity must be a citizen of Bosnia and Herzegovina or a foreigner with the approved permission for temporary stay.

- Physical entity has the right on two .ba domains, out of which one can be the name of a project.

V.I - THE DOMAIN REGISTRATION RULES FOR PHYSICAL ENTITIES

The domain can consist of:

- The name and surname of physical entity, or, according to the wish of the user, some characters can be added. The order of the name and surname, as well as the order of other added characters, is not important (for instance, jasna-filipovic.ba, filipovic-jasna.ba, jasnafilipovic.ba, filipovicjasna.ba, jasnafilipovic23.ba, jfilipovic.ba, jasnaf.ba, filipovicj.ba or fjasna.ba), having in mind that the letters “c”, “c”, “d”, “š” and “ž” must be replaced with “c”, “d”, “s” and “z”;

- The name of the project that the physical entity stands behind (having in mind that the name of a domain cannot be the name of a local community, municipal, town, region or state).

Physical entity has the right on only one domain that has the name of a project, having in mind that the domain can be bought up for a year, with the possibility of time extending after it expires. Only the persons who are over 18 years old can by up that kind of a domain.

V.II - THE DOCUMENTATION NEEDED FOR REQUEST

1. The copy of any valid document with the photograph (identity card, passport, driving licence);

1.1 A foreigner submits a copy of the passport and the approved permission for temporary stay in Bosnia and Herzegovina;

2. The filled in registration for physical entities;

3. The signed contract with UTIC (only for the domain that has the name of a project).


VI - DOMAIN REGISTRATION FOR LEGAL ENTITIES

VI.I-DOCUMENTS FOR .BA, EDU.BA, ORG.BA, NET.BA, GOV.BA, UNSA.BA SUB-DOMAINS APPLICATION

a) The formal request;

b) The copy of the registration decision in the corresponding register of the authorized government agency;

c) The filled in form for the registration of the domain (note: the person in charge for administrative matters, that represents the submitter in the contract with UTIC regarding the questions of the status and documentation in the registration procedure and the use of the domain, must be employed in the institution of the domain user; the person in charge for technical contacts must be qualified for the professional cooperation with UTIC in the procedure of the establishing and the use of the domain);

d) Authorized (bilingual) power of attorney by both firms (only for foreign firms).


VI.II - UTIC MAY APPROVE THE DIFFERENT NAME OF A DOMAIN ONLY IN THE FOLLOWING CASES:

a) If the requested name of a domain is a part of the full name of submitter, represents its abbreviated name or if there is the direct connection between so chosen name of a domain and the name of submitter (for instance, Professional Fire Brigade of Canton Sarajevo has the domain VATROGASCI-SA.ORG.BA);

b) If the requested name of the domain is the name of a project or a product or services that are under the authority or in the direct connection with the activity of the legal entity/entities i.e. the request submitter/submitters (beside the other documents, the document about the existence of the project or the product must be submitted; for instance, the domain NARKOMANIKA.BA is the name of the project of the following organisations: NBV “Drug in the World”, Association for Drug Addict Prevention NARKO-NE, Association FACE TO FACE, Association of Young Teetotallers UMT);

c) If there is the branch of the legal entity which has the different name from it (the proof of court decision of the branch name is needed; for instance, the domain MS-PROCESOR.BA, is the property of the Mijas Trade d.o.o. firm whose branch is called MS Processor).


VII - RIGHTS AND OBLIGATIONS OF DOMAIN USER

a) The domain user is obliged to use the domain only for the purpose which is the domain registered for;

b) The domain user is obliged to use the domain in the established way, i.e. established under the World Internet Association;

c) The domain user is obliged to inform UTIC about any change of data about itself and the use of the domain;

d) The domain user is obliged to cooperate with UTIC on the questions related to limiting and preventing of the activities that represent the misuse of the domain and harm the domain user, i.e. all .BA domain users;

e) The official contacts of the domain users and UTIC, especially when they are related to administrative matters and the questions of rights and responsibilities for the use of the domain, are realised using the addresses that the domain user determined in the forms. During the registration or later change of data, UTIC will give the priority to electronic way of communication;

f) The domain user is responsible for every misuse of the domain. Every registration and use of the domain, which is not in accordance with the purpose of the domain, is considered as the misuse of the domain;

g) The domain user responds for every violation of the third party rights, which is caused by the registration of its domain, especially for the violation of the intellectual property rights (i.e. copyrights, industrial property rights, brand rights as well as copyrighted verbal and geographical marks). UTIC, as the administrator of .BA domain, does not and cannot bear any responsibility. In the case of a dispute between the domain user and the third party, UTIC, as the administrator of .BA domain, does not bear any responsibility toward the disputant parties;


h) The domain user may transfer its domain to another legal entity. In that case, they are obliged to make the statement in UTIC, by which, with the agreement of both legal entities, the former user waives the use of the domain and the new one obliges to use the domain for the (similar) purposes which it is registered for;

i) The domain user must insure the technical conditions for the connection of the domain, check the correctness of the domain connection after the registration, as well as the data published on http://www.nic.ba, and inform UTIC immediately about any change.


VIII - THE DOMAIN MAY BE DEACTIVATED IF ONE OF THE FOLLOWING CONDITIONS IS FULFILLED:

a) The user gave incorrect or invalid data and documentation in the registration procedure or did not obey the contract, which had signed with UTIC (only for physical entities). The request submitter is responsible for correct data in the request and validity of the documentation that was submitted with the request. If the data in the request are found to be incorrect or documentation submitted with the request to be invalid, UTIC may cancel the registration of the domain, and, if it was activated, deactivate it urgently;

b) The user did not inform UTIC about the change of obligatory data about itself or about the use of the domain;

c) The user does not obey its obligations and responsibilities;

d) The user is not able to satisfy the minimum of technical conditions related to the domain functioning, what causes troubles in functioning of the DNS .BA domain;

e) The user misuses the domain in the way that it uses the domain contrary to the purpose which it was registered for;

f) The user misuses the domain in the way that harms the rights of the third party, especially the intellectual property rights, copyrights, industrial property rights, brand rights as well as copyrighted verbal and geographical marks;

g) The domain user does not fulfil its financial obligations for UTIC services.

The decision of the domain deactivation will be delivered to the user at least 24 hours before the deactivation.

The domain user may ask for the change of the domain name. For getting the new name of the domain, the same procedure is carried out as for the registration of the domain.

In the case that the legal entity, the domain user, has ceased to exist, the legal heirs of the legal entity can request the right on the domain and the inheritance on the domain, i.e., the re-registration of the existing domain for their own use, under the condition either to use the domain for the same purpose or to change the domain purpose explicitly. The valid documentation of the legal inheritance must be submitted together with the request.

In the case of the third party objection or the dispute between the third party and the domain user, caused by the misuse of the domain, UTIC as the administrator of .BA domain, does not bear any responsibility toward the parties in the dispute.

UTIC processes the requests for domain registration in the order they were received. From the moment of the receipt of the request to the end of registration procedure, the requested domain is reserved for the request submitter.

The time period in which UTIC is obliged to process the request for domain registration is about 10 days from the receipt of the request.

UTIC will inform the user about the end of the domain registration procedure, and the rights and responsibilities of the domain user start from the moment of the information delivery.

If the user does not send the other documents for the domain registration in 15 days after the registration of .BA domain on www.nic.ba, the domain registration will be erased.

The registered domain is liable to the obligatory annual re-registration, having in mind that the data change and erasing of .BA domain is free of cost.


IX - THE DOMAIN NAME MUST NOT:

a) Enable the domain user to take the false identity of the third physical entity;

b) Enable the domain user to take the false identity of the third legal entity;

c) Be the same or similar as a copyrighted brand, especially a copyrighted verbal mark, unless the request submitter is the bearer of the copyrighted brand or the trade mark (TM);

d) Be the same as any TLD (for instance, arpa, com, edu, gov, as well as all ccTLD names of the other states);

e) Contain the name of a TM if it is not the owner of the TM (for example, Renault-club, because it contains the name of the TM Renault in its name).


X - THE REGISTRATION OF THE DOMAIN MAY BE CANCELED, AND THE DOMAIN MAY BE ERASED IF ONE OF THE FOLLOWING CONDITIONS IS FULFILLED:

a) The domain user asked in the written form the cancellation of the registration and the erasing of the domain;

b) On the basic of the valid documentation, UTIC established that legal entity, which was the domain user, had ceased to exist;

c) The domain user has committed the violation of this rule book (paragraphs IX, X, XI);

The domains, for which the registrations have been cancelled, are deactivated urgently.


XI - EXPANSES AND COMPENSATIONS RELATED TO THE .BA DOMAIN MANAGING

While establishing the expenses and compensations, it is started from the fact that the activity related to .BA domain managing is financed by itself. The expenses related to the activity of .BA domain managing refer to:

- The establishing and maintaining of technical resources (computers, software, link) needed for .BA domain functioning;

- The membership fees in the international agencies related to Internet domain managing;

- The personal expenses of UTIC for DNS administration of .BA domain.

The compensation is charged for:

- The registration of the domain;

- The annual maintaining of the domain.


XII - TRANSITIONAL AND FINAL RULES

This rulebook becomes effective on 20th January 2003.

The previous rulebook for the domain registration under .BA domain ceases to be valid from the day when this rulebook becomes effective.

All the domains that UTIC had registered before the day when this rulebook became effective, remain registered, regardless of the possible disharmony with the rules of this book. The users of these domains are obliged to deliver the documentation, needed for regulating the documentation and the domain with the rules of this rulebook, to UTIC within 6 months after the day when this rulebook becomes effective.
